Leasehold vs Freehold in Sanur

Two very different pieces of paper both get called "buying a villa" here, and only one of them is a registered land title. Freehold, Hak Milik, sits on Indonesia's land register and stays reserved for Indonesian citizens.

Leasehold, Hak Sewa, is a private contract that a foreign buyer can hold directly, and it covers a large share of what actually sells on this stretch of Denpasar. Knowing which one a listing offers changes the price, the paperwork and what happens the day the term runs out.

What Freehold and Leasehold Actually Give You

Indonesia's Basic Agrarian Law keeps Hak Milik, the country's freehold title, out of foreign hands entirely, limited to citizens by Articles 21 and 9, per Melayunesia Law. A foreigner buying "freehold" here is really buying into a structure sitting on top of the land, never the title itself.

Leasehold works on a different basis.

Hak Sewa is a notarised contract, not a right entered on any certificate at BPN, Indonesia's land agency, per BaliPropertyRules. A PPAT or notary drafts and witnesses the agreement, and that document, not a government register, is what protects a buyer for the length of the term.

A PT PMA, the Indonesian company structure many foreign owners use instead, can hold HGB or Hak Pakai over land, never Hak Milik, per Bali Exception. Hak Pakai itself needs a valid KITAS and clears only above Bali's regional floor, a landed house reported at Rp 5 billion under that threshold, per Kompas Properti.

What Sanur's Own Listings Are Asking

Sourced rows beat a single average, so here is what each tenure has actually asked in 2026:

What Tenure Price Source
Land, per are, asking Freehold IDR 1.0 to 3.66 billion per Rumah123, 2026
2-bedroom off-plan villa, one listing Leasehold USD 265,000 per Bali Villa Realty, 2026

The wider villa market that Jarniascyril tracks does not split its asking prices by tenure at all. That gap in the data is itself telling: most sellers are not pricing the tenure distinction this page is asking you to weigh, which leaves that job to the buyer.

Why a Cheap Leasehold Listing Can Mislead

A leasehold price is not directly comparable to a freehold-route one unless you know how many years remain on the contract. Two listings at the same headline price can hand a buyer very different terms. This research has not sourced a cost-per-remaining-year figure for Sanur specifically, so treat any such number a seller quotes you as theirs, not an independent one.

What you can compare honestly is the paper itself. A leasehold buyer holds a time-limited private contract, while the PT PMA route holds HGB, a registered right running up to 30 years before a further 30-year renewal, per Lex Regis's reading of PP 18/2021.

New-Build Stock Splits Leasehold and Freehold

Sanur's own market is not one tenure or the other. Villa compounds and guesthouses dating back to the 1970s through the 2000s still account for most of what long-stay tenants here actually rent, per Solar Property Bali.

New two to three bedroom villas here are sold under both tenures, leasehold and freehold alike, most of them off-plan and clustered around the city's newer hospital-and-mall development wave, per Rumah123 and Magnum Estate. Nothing about the tenure split favours one route over the other; the split simply reflects what individual developers chose to sell.

Sanur Property sees both tenures move through the same streets, so the question is rarely "which one exists here" and always "which one suits what you are trying to do."

Matching the Tenure to the Right Buyer

A retiree or a family planning a long stay often cares more about a stable, well-documented contract than about ever holding a registered title, which makes leasehold a reasonable fit as long as the lease itself is sound. A buyer planning to run a rental business is more likely to want the PT PMA and HGB route, since it is the structure the villa-licensing chain assumes.

One route is never worth the shortcut.

A nominee arrangement, where an Indonesian citizen holds Hak Milik on a foreigner's behalf, breaches UUPA Article 26(2) and was declared void by Supreme Court Circular SEMA 10/2020, with Bali's Perda 4/2026 now banning the practice outright, per Jurnal Aktual Justice and NusaBali. No structure built on that shortcut is safe, whatever a seller tells you.

Frequently Asked Questions About Leasehold and Freehold

What Is the Real Difference Between Leasehold and Freehold in Sanur?

Freehold, Hak Milik, is a registered land title, and Indonesia's Basic Agrarian Law reserves it for citizens under Articles 9 and 21. Leasehold, Hak Sewa, is an unregistered private contract that a foreign buyer can hold directly.

Can a Foreigner Buy a Leasehold Villa in Sanur?

Yes. A Hak Sewa lease is a contract right, not a title BPN records, though a foreign buyer still holds it directly. One two-bedroom off-plan Sanur listing priced this route at USD 265,000, per Bali Villa Realty.

Is a Leasehold Contract Registered at Indonesia's Land Office?

No. Hak Sewa never reaches BPN's register. A PPAT or notary draws up and witnesses the notarised agreement, per BaliPropertyRules, and that document alone protects a buyer, never a government land record.

Can a PT PMA Hold Freehold Land in Sanur?

No. A PT PMA is an Indonesian company that can hold HGB or Hak Pakai, never Hak Milik. It is the structure most foreign-owned villa-rental businesses use instead, per Bali Exception.

What Does Hak Pakai Cost a Foreign Buyer Near Sanur?

Hak Pakai needs a valid KITAS plus a price above Bali's floor, a landed house reported at Rp 5 billion under that threshold, per Kompas Properti. The right lasts 30 years, extendable once for another 30.
